We are delighted to share the success of our recent panel discussion, “Vietnamese Law in International Arbitration,” at Paris Arbitration Week 2025—marking a historic first for a Vietnamese law firm to present at this prestigious event.

Event Highlights

Held on April 8, 2025, from 4:30 PM to 7:00 PM at the GBDS office, the discussion drew a diverse audience of legal practitioners, in-house counsel, and arbitration specialists. Attendees engaged with critical aspects of Vietnamese law’s role in international dispute resolution, especially in the context of commercial and construction-related arbitration.

1. Panel 1: Select Topics in Vietnamese Law

  • Sources of Vietnamese Law: An overview of codes, laws, Supreme Court resolutions, binding precedents, and key regulations.
  • Independence of Arbitration Agreements (Art. 19 of the Law on Commercial Arbitration).
  • Multitiered Arbitration Clauses (including dispute boards).
  • Limitation Periods in foreign-seated arbitrations governed by Vietnamese law.
  • Damages Under Vietnamese Law: Liquidated damages, delay damages, and their enforceability.
  • Applicability of Vietnamese Law Principles to FIDIC contracts, highlighting the Quang Minh case.

2. Panel 2: Enforceability of Foreign Arbitral Awards in Vietnam

  • The New York Convention and Vietnam’s Civil Procedure Code (CPC).
  • Eligibility Requirements (CPC Art. 424).
  • Grounds for Denial of Recognition (CPC Art. 459, codifying New York Convention Art. V).
  • Capacity, Validity of Agreements, Notice, and Scope Issues under CPC Art. 459.1.
  • Tribunal Composition and Award Binding Status.
  • Non-Arbitrability and Fundamental Principles of Vietnamese Law under CPC Art. 459.2, including commentary on pivotal cases.
