Trong b\u00e0i vi\u1ebft n\u00e0y, c\u00e1c t\u00e1c gi\u1ea3 s\u1ebd ch\u1ee7 y\u1ebfu \u0111\u1ec1 c\u1eadp \u0111\u1ebfn Quy\u1ec3n \u0111\u1ecf phi\u00ean b\u1ea3n 1999 (\u201c<strong>RB\/99<\/strong>\u201d) v\u00e0 Quy\u1ec3n \u0111\u1ecf phi\u00ean b\u1ea3n 2017 (\u201c<strong>RB\/17<\/strong>\u201d).<\/p>\n<p>C\u00e1c h\u1ee3p \u0111\u1ed3ng m\u1eabu FIDIC \u0111\u01b0\u1ee3c s\u1eed d\u1ee5ng ph\u1ed5 bi\u1ebfn trong c\u00e1c c\u00f4ng tr\u00ecnh, d\u1ef1 \u00e1n x\u00e2y d\u1ef1ng t\u1ea1i Vi\u1ec7t Nam n\u00f3i chung v\u00e0 b\u1eaft bu\u1ed9c ph\u1ea3i s\u1eed d\u1ee5ng trong c\u00e1c d\u1ef1 \u00e1n s\u1eed d\u1ee5ng ngu\u1ed3n h\u1ed7 tr\u1ee3 ph\u00e1t tri\u1ec3n ch\u00ednh th\u1ee9c (ODA) n\u00f3i ri\u00eang. Do \u0111\u00f3, c\u00e1c h\u1ee3p \u0111\u1ed3ng m\u1eabu FIDIC c\u00f3 vai tr\u00f2 c\u1ef1c k\u1ef3 quan tr\u1ecdng trong c\u00e1c d\u1ef1 \u00e1n \u0111\u1ea7u t\u01b0 x\u00e2y d\u1ef1ng \u1edf Vi\u1ec7t Nam v\u00e0 nh\u01b0 v\u1eady vi\u1ec7c gi\u1ea3i th\u00edch, \u00e1p d\u1ee5ng \u0111\u00fang \u0111\u1eafn c\u00e1c \u0111i\u1ec1u kho\u1ea3n c\u1ee7a c\u00e1c h\u1ee3p \u0111\u1ed3ng m\u1eabu FIDIC theo lu\u1eadt Vi\u1ec7t Nam, th\u01b0\u1eddng l\u00e0 lu\u1eadt \u0111i\u1ec1u ch\u1ec9nh c\u1ee7a h\u1ee3p \u0111\u1ed3ng, l\u00e0 h\u1ebft s\u1ee9c c\u1ea7n thi\u1ebft.<\/p>\n<p>Trong b\u00e0i n\u00e0y, c\u00e1c t\u00e1c gi\u1ea3 ph\u00e2n t\u00edch, gi\u1edbi thi\u1ec7u kh\u00e1i ni\u1ec7m thi\u1ec7t h\u1ea1i do ch\u1eadm tr\u1ec5 (\u201c<strong>THDCT<\/strong>\u201d) d\u00f9ng trong c\u00e1c quy \u0111\u1ecbnh c\u1ee7a RB\/99 v\u00e0 RB\/17 \u0111\u1ec3 k\u1ebft lu\u1eadn r\u1eb1ng kh\u00e1i ni\u1ec7m THDCT c\u1ee7a h\u1ee3p \u0111\u1ed3ng m\u1eabu FIDIC c\u00f3 th\u1ec3 ch\u01b0a ph\u00f9 h\u1ee3p v\u1edbi c\u01a1 ch\u1ebf b\u1ed3i th\u01b0\u1eddng thi\u1ec7t h\u1ea1i theo lu\u1eadt Vi\u1ec7t Nam v\u00e0 do v\u1eady, vi\u1ec7c gi\u1ea3i th\u00edch, \u00e1p d\u1ee5ng c\u00e1c kh\u00e1i ni\u1ec7m \u0111\u00f3 trong c\u00e1c h\u1ee3p \u0111\u1ed3ng do lu\u1eadt Vi\u1ec7t Nam \u0111i\u1ec1u ch\u1ec9nh s\u1ebd kh\u00f3 kh\u0103n, ph\u1ee9c t\u1ea1p.
